America’s largest abortion provider and out-of-state interests are leading an effort to create a right to late-pregnancy abortion in the Nebraska Constitution.

What You Need to Know:

Pro-Abortion advocates released a ballot initiative in November 2023 that would create a right to abortion in Nebraska. Protect Our Rights, a pro-abortion coalition group, filed paperwork in August of last year in support of a ballot initiative that would amend the state constitution to include abortion as a right.  The current law bans abortion past 12 weeks.

Seven states across the nation have put abortion rights to a public vote and succeeded, the latest being Ohio. The Nebraska campaign needs about 125,000 signatures from registered voters. That’s calculated by 10% of the voting block in the state. The signatures also need to cover at least 5% across 38 of the 93 counties, and be submitted by July of this year.

The proposed pro-abortion ballot initiative uses vague, subtle language to deceive Nebraskans and allow unrestricted abortions in our state constitution.

Among many other problematic consequences, this amendment would:

  • Eliminate 50 years of health and safety protections for women and girls from unsafe abortions;
  • Allow teenagers to access abortion without their parent’s knowledge;
  • Provide broad exceptions for health, spiritual, and financial reasons, opening the door for abortions up until birth;
  • Create a right to risky late-pregnancy abortion.

This proposal is dangerous. It’s deceptive. It’s demeaning. It is too extreme for Nebraska.

Pro-Life Ballot Initiative:

Last week, a second abortion-related ballot initiative proposal was released called Protect Women & Children. The proposal provides protections for some preborn babies, and offers Nebraskans an alternative ballot proposal in contrast to the extreme abortion proposal that was released in November by pro-abortion special interest groups.

The language of this newly released proposal states: “Except when a woman seeks an abortion necessitated by a medical emergency or when the pregnancy results from sexual assault or incest, unborn children shall be protected from abortion in the second and third trimester.”

While the language of this proposal doesn’t prevent all abortion, it is morally permissible for Nebraskans to support this newly proposed initiative.

  • The proposal provides constitutional protection for preborn babies during the second and third trimester.
  • The proposal does not create any right to abortion. It leaves protections for preborn babies in the first trimester and in cases of rape, incest, or medical emergency to the Nebraska Legislature.
  • The proposal does not affect Nebraska’s current pro-life law, which protects preborn babies at 12 weeks with exceptions for rape, incest, and medical emergency, and it leaves intact countless health and safety laws passed over the last 50 years to protect women and babies from abortion.

What about No Exceptions?

When pro-lifers think no exceptions are acceptable, you might point them to the following from section 73 of John Paul II’s “Gospel of Life” encyclical:

“A particular problem of conscience can arise in cases where a legislative vote would be decisive for the passage of a more restrictive law, aimed at limiting the number of authorized abortions, in place of a more permissive law already passed or ready to be voted on… when it is not possible to overturn or completely abrogate a pro-abortion law, an elected official, whose absolute personal opposition to procured abortion was well-known, could licitly support proposals aimed at limiting the harm done by such a law and at lessening its negative consequences at the level of general opinion and public morality.This does not in fact represent an illicit cooperation with an unjust law, but rather a legitimate and proper attempt to limit its evil aspects.

 

A voter can support the Protect Women & Children ballot initiative, under the following conditions:

> The voter must understand that all abortion must be opposed, and that direct abortion is never morally acceptable under any circumstances.

> The voter must view this proposal as an incremental step toward full protection of all human life from abortion, and not as a permanent compromise. Supporters must remain committed to the effort of recognizing the right to life of all preborn children.

> The voter must accept that the proposal does not create any right to abortion in the Nebraska Constitution. The Nebraska Legislature remains free to provide greater protection for human life.

> The voter must understand that this proposal is an imperfect alternative to the intrinsically evil pro-abortion ballot initiative proposal launched in November. That pro-abortion ballot initiative cannot be supported under any circumstance and must be rejected.
