Both Pro-Life and Pro-Abortion groups are working to get their respective amendments added to Nebraska’s Constitution and be listed and voted on in the General election ballot this November.
Before amendments can be on the ballot, they must begin as “ballot initiatives,” which are petitions that collect Nebraska voters’ names & signatures that demonstrate there is enough support to put this on the ballot. To meet the deadline, groups have until July 3rd to collect 125,000 valid signatures from 10% of registered voters in Nebraska. In addition, signatures must be collected from 5% of the registered voters in 38 of the 93 Nebraska counties.
Beginning last November, pro-abortion groups have been working to collect signatures to get the Protect the Right to Abortion / “Protect Our Rights” ballot initiative added to the General ballot in November. Their ballot initiative begins: “All persons shall have a fundamental right to abortion until fetal viability, or when needed to protect the life or health of the pregnant patient, without interference from the state or its political subdivisions.”
Those supporting the pro-abortion initiative will use language that sounds like they are fighting for a woman’s right to receive healthcare and for bodily autonomy (remember “my body, my choice”?). They will use scare tactics and misleading statements about the dangers women face because their doctors will be prevented from providing care for situations like miscarriages or ectopic pregnancies. This simply isn’t true. Abortion is not healthcare.
If the Right to Abortion would become law in the Nebraska Constitution, what would this mean for Nebraskans?
- Abortion would be allowed up until birth:
- Nebraska currently bans surgical abortion after 12-weeks
- Nebraska currently bans chemical abortion pills through the mail
- It would negate ALL current prolife laws:
- Eliminate the 12-week ban on abortion that was enacted last year
- Allow dismemberment abortion (banned in 2020)
- Remove parental notification that is required before minors to obtain an abortion (passed in 1991)
- Remove informed consent that requires abortionists to inform women seeking abortion about associated risks (passed in 1993)
- Allow chemical abortion pills to be distributed through the mail (passed in 2011)
- Ends taxpayer funding for abortion from using Title X taxpayer dollars (passed in 2018)
- Eliminate Medical Protections for Women:
- Licensing requirements for abortionists goes away. Anyone can be an abortionist.
- Allow webcam abortions without a physician present. You must verify if there is an ectopic pregnancy, or it can cause severe bleeding or death.
- Eliminate health inspections of abortion clinics. Hospitals, doctors offices and even restaurants will continue to be inspected, but not abortion clinics. (ex: Kermit Gosnell)
- Eliminate Parental Rights & Consent
- I-80 is a corridor for human traffickers. Planned Parenthood has contracts with abortion clinics, where human traffickers can bring their victims. Visit the Nebraska Attorney General’s Office as well as the website: “I’ve Got a Name” to learn more.
- In addition to human traffickers, young women are groomed. Because parental consent laws are in place, parents are able to be informed and know their daughter is seeking an abortion!
Since Roe v. Wade was overturned, SEVEN states have lost the battle to protect unborn children.
Voters have sided with abortion rights supporters every time the issue has been directly on the ballot since the U.S. Supreme Court overturned the nationwide right to abortion in 2022.

Pro-lifers in Nebraska have an opportunity to fight the pro-abortion legislation at the ballot box with this pro-life ballot initiative, called Protect Women & Children, but we need your help!

This pro-life ballot language states:
“Except when a woman seeks an abortion necessitated by a medical emergency or when the pregnancy results from sexual assault or incest, unborn children shall be protected from abortion in the second and third trimester.”
The Protect Women & Children Ballot Initiative that is currently collecting signatures would:
- Create a constitutional protection for unborn children! No other state in the US has this protection!
- Preserve all of our current pro-life laws, including our recent 2023 law that bans elective abortions after 12-weeks gestation.
- The exceptions noted are very small. These are the DHHS Statistical Abortion numbers for Nebraska in 2022:
- Sexual Assault = 6 abortions 0.2% of abortions
- Incest = 0 abortions 0.0% of abortions
- Medical Emergency = 2 abortions 0.1% of abortions
- This does not prevent further pro-life legislation from being passed; rather, it holds the line on all current legislation!
- This is an imperfect but incremental step towards the goal of protecting ALL life, from conception to natural death.
